Sino-Italian Law Forum Serial Lectures: Jurist Su Yongqing gave a lecture on Concept of Civil Code -- Taking Debt in REM as an Example

Prof. Su Yongqing, a well-known civil law scholar cross-Straits, was invited to give a lecture on the Concept of Civil Code -- Taking Debt in REM as an Example to the students on Haidian Campus on the evening of 21 Sept, 2024.



The lecture was held online and on-site. Prof. Fei Anling from the College moderated the lecture. Dean of the School of Civil, Commercial and Economic Law of the University Prof. Yu Fei, Director of the Institute of Civil Law of the school Prof. Yi Jun and Prof. Zhai Yuanjian from the College were the commentators.



Through the analysis of the arguments in the German code, Su Yongqing pointed out that the Pandect (Pandekton) system is shaken, and put forward the idea of the great civil code, emphasising systematisation and scientization and pursuing the ‘Just law’. He analysed the characteristics of the civil code and the special civil law, put forward the new system of “the combination of debt and property”, discussed the social cost of property law and freedom, and proposed the opening of property rights space according to Taiwan region's ‘Civil Law’ Article 826-1. Su also proposed a new five-part civil code system, comparing the differences between the cross-Straits civil code, and suggested that the new civil code scheme can be gradually advanced.



During the event, Fei Anling pointed out that the scientific nature of property-debt dichotomy was questioned and the law should be adjusted to reflect the idea of justice, and stressed the importance of law-economic analysis method combined with big data. Yu Fei believed that the system of civil code still needs to be systematised and scientific. He proposed a system of debt and property integration, and criticised the purposive reduction from the original legislative intent. Yi Jun summarised Su 's theory as maximising autonomy space and system effects, stressing the importance of system thinking in the development of law. Zhai Yuanjian pointed out that the legal rules need to adapt to the development of the times to make changes.



During the Q&A session, students enthusiastically asked questions and Su patiently answered them. At the end of the lecture, Fei thanked Professor Su, the panelists and all the teachers and students present. The lecture concluded in a friendly and harmonious atmosphere.
