CCL organises Seminar on China-Style Modernisation and Insurance Law Revision

The Seminar on China-Style Modernisation and Insurance Law was held on Xueyuanlu Campus on the afternoon of 18 June, 2023. The conference was hosted by the China Association of Insurance Law, organised by the College of Comparative Law and co-organised by the Beijing Jiena Ruisen Management and Consultancy Company. Over 50 dignitaries from higher education institutions, judicial system and law practice attended the meeting.



A/Prof. He Qihao from the College moderated the opening ceremony. President of the China Association of Insurance Law and professor at the Peking University Law School Yin Tian and Dean of the College Prof. Xie Zhiyong presented the remarks.



Yin Tian pointed out that people should always firmly believe that democracy and the rule of law are the way forward for Chinese society in the future. In the process of China-style modernisation, the management and development of the insurance industry is also a very important link. The insurance law should give more play to its practical characteristics and help the country's insurance industry to achieve long-term healthy development by revising and perfecting itself continuously. He also wished the conference every success.



Xie Zhiyong first warmly welcomed President Yin Tian and the distinguished guests. He wished the meeting a complete success in advance and also welcomed everyone to pay more attention to the China University of Political Science and the College of Comparative Law. He welcomed all the scholars to visit the College and also called for more support to its excellent teaching faculty such as Prof. Bo Yanna and He Qihao.



The first session of the seminar mainly focused on the basic theoretical issues of insurance law, such as moral hazard and insurance interest. Li Zhuyong, Vice President of the China Association of Insurance Law & Executive Vice President of the People's Insurance Group Co., Ltd., presided over the meeting.


Prof. Sang Benqian from the Law School of Ocean University of China presented his report first on the Reflection on the Basic Theory of Insurance Law. Prof. Wang Ping from the School of Juris Master of CUPL, Judge Chang Xiuliang from the Cangzhou Intermediate People's court, Member of the Legal Professional Committee of China Association of Insurance Law & Director of Zhejiang Jinghag Law Firm Shou Baojin, Prof. Li Qingwu from the School of Law of University of International Business and Economics gave comments on the report.


The second session focused on various issues related to insurance law in judicial proceedings. Guan Xiaofeng, Vice President of the China Association of Insurance Law & professor at the School of Civil and Commercial Law of CUPL moderated the meeting.



Vice President of Beijing Financial Court Xue Feng gave his report on the Judicial Adjudication and Insurance Amendment. Prof. Zhang Junyan from the School of Finance of Renmin University of China, Judge Zhang Zehua from Third Court of the Beijing Finance Court, Liu Changkun from the Beijing Jiena Ruisen Management and Consultancy Company presented their comments on the report.


The third session focused on the governance, withdrawal and supervision of Insurance companies. Vice President of the China Association of Insurance Law and professor at the Renmin University of China Jia Linqing moderated the session.



Prof. Bo Yanna from the College of Comparative Law presented her report on the Exercise and Restriction of Shareholders' Rights in the Risk Management of Insurance Companies. She explained the concept of risk governance of insurance companies, the normative review of the exercise and limitation of shareholders' rights, the legal basis of the exercise and limitation of stock rights, the power boundary of the exercise and limitation of stock rights, the normative path of the exercise and the suggestions of entering the law. The report covered not only the exercise of self-interest and co-interest rights, mandatory capital injection, penetrating supervision, the principle of the source of power in the United States, the aggravation of shareholder responsibility, autonomy and co-governance, and the connection between laws and regulations, but also involved a lot of comparative law studies in the US, Japan and Germany. Her report comprehensively and systematically expounded the special problem of the exercise and restriction of the rights of insurance company shareholders, and inspired other scholars to explore the insurance company governance.


Prof. Zhou Xuefeng from the School of Law of Beihang University, Associate Dean of the School of Law of Beijing Technology and Business University Prof. Dong Biao and CEO of the Beijing Jiena Ruisen Management and Consultancy Company gave their comments on the presentation.


The fourth session focused on issues related to the insurability of emerging risks and the countermeasures of insurance law to emerging risks. Vice President of the China Association of Insurance Law and Senior Legal Consultant of the China Pingan Insurance Group Yao Jun moderated the session.



A/Prof. He Qihao presented his report. He gave an in-detail introduction to the problems, the insurability analysis of emerging risks, theoretical basis and practical difficulties of emerging risk insurance, and theory, system and rules to improve the response.


Prof. Chen Jingshan from the Civil, Commercial and Economic Law School of CUPL, Prof. Xing Haibao from the Renmin University of China Law School and Head of the Legal Compliance Department of PICC Property and Casualty Company Limited Qiao Shi gave comments on the report.


Prof. Ren Zili from the School of Law of Beijing University as well as the Vice President & Secretary-General of the China Association of Insurance Law presented the closing remarks. Ren said that the content of this meeting was very in-depth and rich. He believed that all participants had a great harvest,


“The seminar on the revision of the insurance law is a series of activities. It has been held in Shanghai Jiao Tong University, Nanjing University and China University of Political Science and Law. In the future, it will continue to be held in Renmin University of China and Dalian Maritime University. The process of insurance law revision is long, and we can conduct more in-depth and thorough research and discussion on related issues.”
